What type of damage or injuries can I be compensated for?

  • Dog or animal bites that can cause injury, disease or even be fatal. These may be caused by your neighbour’s dog, a horse or an animal at a petting zoo.
  • Sporting injuries can range from being hit by a golf ball to tripping while bushwalking. You may be able to make a claim for compensation against a local council or government, personal trainer, sporting club or facilities provider if you’re injured while doing a recreational or sporting activity.
  • Injuries in public places like shopping centres, restaurants, nursing homes or schools. This may include slip, trips or falls, but could also be caused by assault, bullying, harassment or other forms of injury.
  • The death of someone caused by another’s person’s action or inaction.
  • Damage to your goods, buildings or land.

What happens if my dog bites someone on my property?

If your dog bits someone on your own property you may have some liability to the other person. This will depend on the extent of the injuries, who the person is and whether you invited them onto your property. You may possibly be insured for this type of injury or otherwise be liable for compensation. How do I make a public liability compensation claim in NSW?

If you think you may have a public liability claim, there are several things that you will need to do. This includes:

  • Collect any evidence that you need to support your claim: Our lawyers can help you collect evidence. This may include seeing a doctor, telling them how you were injured and getting a medical certificate, reports, treatment plans or a report from an independent medico-legal examiner. You can also take photos or videos of your injuries for evidence. Your medical expense receipts and records of all the appointments and consultations that you have will also form part of your evidence. Any relevant financial information that you have can also be evidence, this includes payslips, tax returns and a record of any other expenses that you have incurred, including any days where you have lost wages because you can’t work.
  • Complete the necessary forms: Once you have all your evidence, you will need to use them to help you answer questions in the forms. There are several forms that may need to be completed as part of your claim, our personal injury lawyers can guide you as to which ones need to be completed.
  • Send the forms to the other party: The other party is the person who you’re making a claim against or their insurer. Once they receive your forms they will tell you whether they are compliant or if they would like to see any of your evidence. They also have the right to ask you to be examined by one of their independent medico-legal specialists.
  • Attend a compulsory conference: Under the law you will need to attend a compulsory conference with the person you’re claiming from. This conference is an opportunity to try to negotiate and settle your claim before going to Court. The person you’re making a claim against may make you an Offer of Settlement at this conference. If you accept the Offer of Settlement then you will not be able to make any further claims or go to Court, even if you sustain additional injuries after this date. You should not accept an Offer of Settlement without speaking to our public liability lawyers first.
  • Go to Court: If you choose not to accept the Offer of Settlement, your claim will probably go to Court.

If I am at fault can I make a claim?
